The High Court of Madhya Pradesh has mandated a thorough investigation into allegations of financial misconduct against the Aastha Education Society, which operates several educational institutions, including a medical college.
In a ruling delivered on October 9, Judge Vishal Mishra noted that the society's audit report indicated financial discrepancies amounting to ₹200 crores, and under these circumstances, no relief could be granted to the petitioner.
The society had filed a petition seeking the cancellation of a First Information Report (FIR) lodged by the Economic Offences Wing (EOW). The court remarked that the FIR was based on audits conducted by reputable auditors, whose reports are recognized by the government at various levels.
The order highlighted clear indications of significant financial embezzlement, necessitating a comprehensive investigation by the EOW. The petition submitted by society officials Shweta Choukse, Jai Narayan Choukse, Dharmendra Gupta, and Anupam Choukse stated that the Aastha Society does not receive any financial assistance from the government.
The petition also claimed that the respondent, Anil Sanghvi, is a former member who had previously filed a complaint with the EOW, which was dismissed by the investigative agency. The society argued that the current allegations are identical to those previously made.
The EOW initiated the case without issuing a notice or providing an opportunity for clarification. The petitioners expressed concerns about the possibility of their arrest. During the hearing, the EOW presented the case diary to the court and argued that the investigation is still in its preliminary stages. After hearing both sides, the judge dismissed the petition.
